General Terms and Conditions
of Tallow GmbH
1.1. These General Terms and Conditions (“T&Cs”) apply to all deliveries by Tallow GmbH to consumers. Our offers are directed exclusively at consumers. By placing an order in our online shop, you declare that you are acting solely for private purposes.
1.2. A consumer is any natural person who enters into a legal transaction for a purpose that cannot be attributed primarily to their commercial or independent professional activity.
The purchase agreement is concluded with Tallow GmbH, Owner: Niklas Spiegel, Ece Spiegel Forchenrainstr. 39/1, 70839 Gerlingen (hereinafter “Tallow”). Further information can be found in the Legal Notice of our online shop.
3.1. The presentation of products in the online shop www.tallows.de does not constitute a legally binding offer, but merely an invitation to place an order.
3.2. By clicking the “Buy Now” button, you are submitting a binding order for the goods listed on the order page. This constitutes an offer to enter into a purchase agreement. Your purchase agreement is concluded when we accept your order by sending you an order confirmation via email immediately after receiving your order, or at the latest, upon shipment of the goods.
3.3. In the case of prepayment or direct payment, the contract is concluded when we request and you complete the payment. The receipt and order confirmation will follow immediately.
3.4. We store the contract text and will send you the order details as well as these Terms and Conditions, including the cancellation policy, by email.
4.1. As a consumer, you are entitled to a right of withdrawal in accordance with statutory provisions. The cancellation policy, including a sample withdrawal form, is attached as an appendix.
4.2. If you, as a consumer, exercise your right of withdrawal under section 4.1, you are responsible for the regular costs of returning the goods.
4.3. Please return the goods in their original packaging with all accessories if possible. Not following this instruction does not affect your right of withdrawal, but it helps us process your return more efficiently.
5.1. The prices listed on the product pages include statutory VAT and other price components.
5.2. In addition to the stated prices, shipping costs may apply. Standard shipping within Germany costs €3.99. The shipping costs will be clearly indicated to you again on the product pages, in the shopping cart system, and on the order page.
5.3. Payment is generally made in advance. Common cashless payment methods (e.g., credit card, standard online payment services) are available to you. The payment methods available to you will be displayed during the ordering process.
5.4. Any refunds will be issued to the payment method used during the ordering process.
6.1. The delivery time varies depending on the destination country and shipping provider. Deliveries within Germany are typically made within 4 business days after order confirmation or, in the case of advance payment, after receipt of payment. Delivery times for international orders may differ. Shipping is handled by DHL. For deliveries outside the EU, the customer is responsible for any applicable customs duties and taxes.
6.2. Until payment has been made in full, the goods remain our property.
7.1. Gift certificates can be purchased in the online shop at www.tallows.de with fixed or individually selectableamounts. Shipping is free and takes place by email as a digital certificate (PDF with voucher code) after payment (see section 5 of these Terms and Conditions).
7.2. The use of other vouchers, discount codes, or coupons to purchase gift certificates is not permitted.
7.3. The currency in which the certificate is issued must match the currency in which it is redeemed. The certificate amount can be used across multiple orders until fully spent. Remaining balances stay on the certificate and can be redeemed again. The balance does not accrue interest. If the value of the certificate is not sufficient, the difference can be paid using another available payment method. Multiple certificates can be combined in a single order.
7.4. Tallow may make payment with a releasing effect to the respective holder or user of the voucher, unless Tallow has positive knowledge or is grossly negligent in not knowing about any lack of authorization of the user.
7.5. Gift vouchers are valid for three years from the date of issue, starting from the end of the calendar year in which the voucher was purchased. After that, they can no longer be redeemed.
7.6. If an order paid for wholly or partially with a voucher is canceled or returned, the corresponding amount will be refunded by crediting the same voucher.
7.7. The right of withdrawal according to section 4 of these Terms and Conditions applies when purchasing a gift voucher.
8.1. Statutory liability for defects applies, i.e., you have the right to demand subsequent performance, withdraw from the contract, or reduce the purchase price.
8.2. Obvious transport damage should ideally be reported immediately to the delivery agent and to us. Failure to do so does not affect your statutory rights.
9.1. Tallow is liable without limitation for intent and gross negligence, in the case of express assumption of guarantees or fraudulent concealment of defects, as well as for damages resulting from injury to life, body, or health. Liability under the Product Liability Act remains unaffected.
9.2. Furthermore, Tallow is fully liable for breaches of obligations whose fulfillment is essential for the proper execution of the contract, whose violation endangers the achievement of the purpose of the contract, and on whose compliance you as the customer may regularly rely ("cardinal obligations"). In the event of a slightly negligent breach of cardinal obligations, we are only liable for foreseeable, contract-typical damages.
9.3. Otherwise, and subject to sections 9.1 and 9.2, liability is excluded.
9.4. The limitation of liability set forth in this section 9 also applies in favor of the company’s officers, agents, or vicarious agents.

11.1. The contract language is German. Any translations into other languages are provided for informational purposes only.
11.2. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, while mandatory consumer protection rights of your country of residence remain unaffected.
12.1. Before initiating legal action, we strive to reach an amicable settlement. Tallow is generally willing to participate in a formal dispute resolution procedure before a consumer arbitration board. The responsible consumer arbitration board is: Universalschlichtungsstelle des Bundes Zentrum für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de.
12.2. If, at the time of concluding the contract, you had your residence or usual place of abode in Germany and subsequently relocate abroad after the contract has been concluded, or if your residence or usual place of abode is unknown at the time legal action is filed, the exclusive place of jurisdiction for all disputes arising from or in connection with this contract shall be the registered office of Tallow GmbH in Gerlingen.
12.3. If any provision of these Terms and Conditions is or becomes invalid, the remainder of the contract shall remain effective. The same applies in the event of any regulatory gaps.
